Summary — The Ministry of Justice is a typical institution of Civil Law regulations in which the principle of the independence of the judge has asserted itself with difficulty, but the prospect that such an institution can operate as a useful regulator of the legislative activity has brought about a certain interest in it also in the countries of Common Law. The functions actually carried out by the Italian Ministry of Justice, which are analysed in the article, nevertheless do not justify prospects of this kind and the obsolete character of its organization is already clear from the out-dated denomination, unlike the one used by the Constituents, generally adopted to indicate it.
