Summary — The right of education, guaranteed by the Constitution of the Italian Republic within social rights, introduces into the ordinary legislation various aspects such as the offer of public education, ancillary services, special terms granted to student workers. Moreover the constitutional and the administrative law cases have contributed to define the contents of the right of education, also as regards the attendance at non-State schools. Recently also the problem of public financing to non-State schools has been regarded as an aspect of the constitutional right of education. The comprehensive analysis of the legislation and of the law cases shows however that the structure of social right peculiar to the right of education remains unchanged.
