LUCIANO MUSSELLI

Libertà religiosa e Islam nell'ordinamento italiano

N. 173

Summary — The strong Islamic immigration in Italy highlights the problems of the defense of freedom of religion and worship for people belonging to this religion. This is a very delicate matter since some principles and precepts of the Koran, most of all those concerning marriage and family law, are at odds with the fundamental principles of Italian law.

This makes it very difficult to establish an agreement with Islam as was done with other religions (Catholicism Judaism, Waldensian religion etc.). The possible solution is therefore a reform and modernisation of the old 1929 law on non-catholic religions that should be replaced by a new law on religious freedom (whose bill was prepared by the government in its period of office before the elections) giving full application to article 19 of the Italian constitution.
