Summary - The Author first of all examines the question of defence in Parliament. After looking into the organisation of the Armed forces he points out the lack of a constitutional regulation in the event of war as art. 78 of the Constitution has never been applied. The Constitution rejects war but consents to participation in peace actions. There are no regulations for states of emergency or military missions or for peace-making operations. The Author underlines the problems for the "constitutional" command of the Armed forces assigned to the President of the Republic, and for the Supreme Council of Defence. The insolvement of the constitutional organs is linked to unwritten rules. The Government can make urgent decrees for the use of all immediate and necessary measures and to prolong them, but sometimes only one motion has been carried. Finally, the Author explains all armed interventions up to the present Kosowo crises.
