The current study addresses
the incorporation of international environmental
law treaties in the Brazilian legal
system and the legal discussions stemming
from this issue. This research concludes that
international environmental law treaties,
which are human rights treaties, have constitutional
hierarchy in Brazil. Consequently,
they are part of a threshold controlling and
reviewing the production of domestic norms.
This research also concludes that environmental
treaties incorporated into the Brazilian
legal system have an immediate self-executing
application: they do not require any
presidential decree, apart from ratification, to
grant domestic application.
