The italian reform of local public services gives local authorities the possibility to enhance laws that could be not consistent with national competition law. Starting from the reform of Vth title of the italian constitution and from the distinction between promotion of competition by regulation or by antitrust law, the article tries to solve the hypotetical inconsistency between a local public services law and the national antitrust law identifying three solutions and clarifying the role of italian antitrust authority
