The aim of this essay is to propose a few scattered notes on the relation between bioethics, law and individual rights in the light of the Italian Constitution. There is no explicit reference to bio-law in our Constitution, but some references can be found in some norms that highlight the connection between the body, the people and public authority (see, for example, the articles 9, 13, 31, 32 and 33). As the Constitution does not provide a hierarchy of values, it is always necessary to carry out a “balancing test” between opposite interests: the main problem is to identify what the best interpreter would be for this kind of operation. The possible solutions are probably the following: self-regulation, judicial decisions and the law.
