"Qualità della vita e sostenibilità ambientale: principi costituzionali e regole"

The article discusses constitutional norms concerning sustainable development and environment, with a view to emphasising the major significance that the international legal order as well as national legal orders attach to these principles. It also points out some links (impact assessment – technical rules – information) that can be drawn from the analysis of different national laws. “Environmental sustainability” is framed as a constant search for balance between economic growth and the protection of environmental conditions. A unifying feature of environmental law may be identified in liberal democratic countries. As a matter of fact, principles are aimed at legitimising State intervention to protect the environment, while rules impose limits and constraints on economic activities. These rules and principles are framed according to criteria which are meant to allow an environmental impact assessment of the main public and private works and strategic programmes, which in turn affect land management and living conditions. Italy has developed vast environmental legislation that largely reflects the orientations and prescriptions which stem from EC law. National legislation configures a framework which seems to the Author complex and fragmented, given the lack of a comprehensive approach, defined according to principles and general rules, made effective through concrete and strict implementation.
