"Costituzione economica italiana ed europea: riflessioni alla luce del principio di coesione"

It is often stressed that there may be a sharp contrast between Italian and European economic constitution. As a matter of fact, articles 41 to 43 of the Italian constitution frame a model which seems to behalfway between market economy and socialism, while the European Treaties are tightly connected to the first one. Such a contrast may be solved by simply referring to the prevalence of EU law in the national order. Nevertheless, it is usual to find a possible meeting point between these two levels through the principle of cohesion. The aim of economic, social and territorial cohesion contained in the EC Treaty and now in the Lisbon Treaty refers to specific EU policy the but also to the EU on the whole and to member States. Thus, EU law envisages a specific political instrument of intervention in the economy and forces national orders to pursue it. EU cohesion is aimed at reducing disparities between regions and social groups, developing their inner potential and thus creating a functioning social market economy. At the Italian national level, this balance does not contrast with the written economic constitution, if we identify the aim of State intervention in the principles of subsidiarity and equality: both of them belong either to the European cohesion principle or to the national Constitution.
