"Parchi naturali e aree protette. Profili di diritto comparato"
The protection of nature was one of the first issues confronted in the environmental legislation of many countries. Without going too far back in time, it can be seen that already in the last century and in the first decades of this one, there are examples of laws instituting natural parks and protected areas, as well as of laws protecting landscapes, flora and fauna.
Having examined the main international initiatives for the protection of nature, interventionist programs and sectorial cross-border environmental measures, the author reveals the way in which a comparison of organizational set-ups and legislation can provide useful indications about the institution and running of natural parks and protected areas, taking into account of: (a) the special legal protection granted to the natural area, (b) the relations between conservation and enjoyment, and (c) the typology with which the various areas can be classified. The author concludes by giving reasons for appreciating a new research frontier that makes use of efficient instruments for the running and control of protected areas (from monitoring, in various forms allowed by new technologies, to surveys by satelite).
