"Le droit de l´environnement et le développement durable: l´approchecomparé à la matière environnementale méthode juridique fondée sur les principes"

The A. discusses constitutional norms concerning sustainable development and environment principles, to emphasize the major significance that the european and the international legal order as well as national legal orders attach to these principles. “environmental sustainability” is framed as a constant research of a balance between economic growth and protection of environmental conditions. A unifying feature of environmental law may be identified in liberal democratic countries. As a matter of fact, principles are aimed at legitimising State intervention to protect the environment, while rules impose limits and constraints on economic activities, according to criteria meant to allow an environmental impact assessment of the main public and private works and strategic programmes, which in turn affect land management and living conditions.
