During the past centuries, maritime piracy has been a constant danger for those who sailed the seas. Although people might think that this is a phenomenon long gone, however, piracy continues to pose a threat to those who sail off in some countries, whose political instability impedes the effective control of the seas. The Montego Bay Convention on the Law of the Sea provides the definition of piracy in Articles 101 and 102, but it does not impose on States the exercise of jurisdiction in the high seas area. The article aims to carry out an analysis of the tools that in recent years have been used in international law to determine the responsible Member States from time to time to judge the pirates, up to the possible establishment of anti-piracy courts. The very large number of attacks, which is constantly increasing, has now made necessary to establish which are the Countries competent to exercise jurisdiction in accordance with international human rights standards.
