"Giustizia indigena e giustizia coloniale. Codifiazione e formazione del giudice"

The article intends to examine essential features of the administration of justice in the colonial era, with particular reference to the major models of France and Great Britain, and in order to place on the systematic plan the case of Italy is primarily considered. The impact of the institutions of European law on the traditional African legal customs in order to verify the survival of the latter in the particular colonial context, through both collections of customary norms promoted by European settlers, and by the jurisdiction of the indigenous tribunals. Special attention is devoted to little-known experiences, as it happens for the indigenous pre-colonial Afro-Malagasy codifications of 1881 and 1889, later recognized by the French judiciary legal system for the colonial Madagascar in 1909.
