"Il declino del Parlamento e la funzione legislativa"

In line with the principle of the separation of powers, parliament is traditionally considered the institution charged with legislative power. However, the thesis of the decline of parliaments, first formulated by Lord Bryce at the beginning of the twentieth century, claims that parliaments are losing their central role within democratic political systems, since governments are progressively taking over a wider range of their legislative prerogatives. In this article, the thesis of the decline of parliaments will be discussed arguing that the legislative function is only one of the relevant functions played by parliaments within the political system. Along with the legislative function, we can identify other relevant activities of the parliament: the representative function, the government formation function and the legitimizing function. Accordingly, even if parliaments are losing legislative power in their relationship with the government, we cannot conclude that the central role of parliaments among political institutions is in decline.
