In accordance with
the provision of article 106 of the Constitution, the President of the
Republic hereby makes the following Provisional Oder
Title and
Commencement
1. This Provisional Order may be cited
as "The University of Juba Act, 1975" and shall come into force on signature
(Signed 9th November, 1975).
Definitions
2. In this Act unless the context
otherwise requires:
"The University" |
means the University of
Juba |
"The National Council" |
means the National Council
for Higher Education |
"The Council" |
means the Council of the
University |
"Vice-Chancellor" |
means the Vice-Chancellor
of the university |
"Secretary General" |
means the Secretary-General
of the University |
"Dean" |
means the Dean of any
College or Institute |
"Academic Staff" |
includes Professors, Lecturers,
Secretary-General, Dean of Students and such other persons as the Council
may from time to time prescribe |
"University Officials" |
means all members of the
academic staff and other employees of the University except the Vice-Chancellor |
Establishment
of the University
3. There shall be established in Juba
City a University known as "The University of Juba" which shall be a corporate
body with perpetual succession and a common seal, and shall in that name
sue and be sued.
Functions
of the University
4. The University shall, within the
bounds of the general policy of the state and the programmes prescribed
by the Council have the following objects:
(1) To study and search for the natural
resources with the object of promoting and developing the same, and to
prepare qualified cadres in the sciences pertaining to such resources for
the purpose of promoting the rural environments in the Southern Region
and such similar regions all over the country.
(2) To prepare assisting cadres of
technicians and advisers and open doors to such rural citizens who obtain
reasonable qualifications so as to improve the performance of such citizens
and blend experience with knowledge.
(3) To undertake such sociological
studies as may be necessary for environmental promotion and to graduate
qualified cadres in the sciences of economics, public administration, business
administration, and community development.
(4) To inculcate the aims of national
unity and diversified culture through sociological studies and any other
means.
Freedom
of thought and Scientiffic [sic] Research
5 The University shall enjoy freedom
of of [sic] thought and scientific research in accordance with the Constitution
and the laws in force.
Academic Organization of the University
6 (1) There shall be established in
the University the following Collages:
(a) the College of Natural Resources
and Environmental Studies
(b) the College of Social and Economic
Studies
(2) The Council shall establish the
departments and units of each college and may also establish any additional
colleges or institutes of the University.
The Chancellor
7 The President of the Republic shall
be the Chancellor of the University and may, in that capacity, issue such
directives as the may deem appropriate in accordance with his constitutional
and legal powers.
The University Council
8 There shall be established by a
Presidential Order a Council to administer the University, which shall
be constituted as follows:
(a) The Chairman
(b) Six members experienced in and
devoted to higher education, representing the Provinces of the Southern
Region.
(c) Two members representing the People's
and vocational organizations in the Southern Region.
(d) Five members well versed in higher
education.
(e) The Vice-Chancellor, University
of Khartoum.
(f) The Vice-Chancellor, University
of Gezira.
(g) The Vice-Chancellor, Khartoum
Polytechnic.
(h) Dean, Faculty of Veterinary Science,
University of Khartoum.
(i) Dean, Faculty of Agriculture,
University of Khartoum
(j) Vice-Chancellor of the University.
(k) Secretary-General of the University.
(l) Deans of Colleges and Institutes.
(m) Dean of Students.
(n) Two members representing the students
who shall be appointed in accordance with the regulations
The Chairman
9 The President of the Republic shall,
in consultation, with the Chairman of the National Council appoint an experienced
and competent person as Chairman of the Council and such person shall,
in that capacity be responsible for presiding over an leading the Council,
and shall have the right to initiate such plans as may be necessary to
ensure the implementation of the policy prescribed by the State and the
National Council.
Functions
and Duties of the Council
10 (1) The Council shall be responsible
for laying out the general policy of the University and supervision of
its works and shall ensure the good performance of the functions of the
University and the exercise of its powers on sound basis.
(2) Without prejudice to the generality
of the foregoing the Council shall exercise the following powers:
(a) to supervise over the properties
of the University. To prescribe the matriculation fees in accordance with
the policy laid out by the National Council and to approve the annual budget
of the University;
(b) to enter into contracts on behalf
of the University.
(c) to lay out such plans as may be
necessary for the improvement and development of the University administration
and the methods and manner of a carrying out its functions including the
establishment or abolition of colleges or institutes or departments and
the creation or abolition of posts and the appointment of the employees
of the University,
(d) to establish such academic or
honorary degrees or any other academic awards as may be necessary in accordance
with the directives of the National Council and the provisions of the basic
rules.
(e) submission of periodical reports
on the activities of the University to the National Council,
(f) to make basic rules in relation
to any matters which may under this Act, be within its power or supervision,
and the University and all the members thereof shall abide by these basic
rules; and it may amend or delete any of the provisions of such rules;
(3) The Council may delegate any of
its powers to the Chairman thereof with such conditions as it may deem
appropriate.
Meetings
of the Council
11 The Council shall make regulations
for the organization of its meetings and the means of carrying out its
functions. The regulations shall be signed by the Chairman; the Council
may, from time to time amend such regulations.
Committees
of the Council
12 The Council shall establish Committees
from amongst its members which may be entrusted with such functions as
the Council may deem appropriate.
The
Financial and Administrative Committee
12 (1) There shall be established
an administrative and finance committee responsible, in addition to what
may be prescribed by the basic rules, for the following functions:
(a) The preparation of the University's
annual budget and statement of accounts and submission thereof to the Council;
(b) The determination with the consent
of the Council, of the terms of service, of the University employees;
(c) the invitation of any person to
attend any meeting or part thereof, provided that such person shall have
no power to vote;
(2) The administrative and Finance
Committee shall consist of:
The Chairman of the Council
The Vice-Chancellor, who shall act
as Chairman (when the Chairman is absent)
The Secretary-General
The Dean of Students
Two members appointed by the Chairman
of the Council from amongst the members appointed under paragraphs "b"
and "c" of section 8.
Vice-Chancellor
14 (1) There shall be a Vice-Chancellor
of the University appointed by the President of the Republic, in consultation
with the Chairman of the Council; his terms and duration of service shall
be determined by a Presidential Order.
(2) The Vice-Chancellor shall administer
the University, achieve its objects, and shall be responsible to the Council,
through its Chairman, for the proper discharge of the University's functions.
(3) The Vice-Chancellor shall be the
Chairman of the Senate.
(4) The Vice-Chancellor shall generally
be responsible for maintaining the high efficiency and discipline of the
University according to the Laws in force. He shall also be responsible
for the University properties and monies.
The Secretary-General
15 The University shall have a Secretary-General
who shall be appointed by the President of the Republic, in consultation
with the Chairman of the Council, to work under the supervision of the
Vice-Chancellor, for the management of financial and administrative affairs
of the University, in accordance with the Statutes made by the Council.
Dean of Students
16 The University shall have a Dean
of Students, responsible for the general welfare of students, the proper
utilisation of their resources, the co-ordination of their general activities
inside and outside the University, and maintenance of discipline amongst
them. He shall be appointed by the Chairman of the Council in consultation
with the Vice-Chancellor.
Budget
of the University
17 The University shall operate according
to a budget to be prepared by the Council and ratified by the National
Council.
Statutes
and Regulations
18 The Council shall make Statues
and Regulations necessary for the implementation of provisions of this
Act, and such Statutes and Regulations shall come into force on signature
by the Chairman of the Council.
College Boards
19 Each College and Institute shall
have a College Board for the discharge of the duties as prescribed in the
Statutes and shall be constituted by regulations to be made by the Council.
Deans of
Colleges
20 There shall be a Dean for each
College and Institute appointed by the Chairman of the Council after consultation
with the Vice-Chancellor, and his authority and functions shall be determined
by the Statutes.
The Senate
21 There shall be established a Senate
of the University which shall consist of:
(a) The Vice-Chancellor of the University
- Chairman
(b) The Secretary-General
(c) The Dean of Students
(d) The Deans
(e) Two members to represent the academic
staff in the status of Professor.
(f) Two members to represent the academic
staff below the status of Professor.
Functions
of the Senate
22 (1) The Senate shall, within the
framework of the policy and programmes prescribed by the Council, be concerned
with the following:
(a) to lay down the academic requirements
for the admission of students in the University;
(b) to regulate programmes and courses
of study;
(c) to supervise examinations and
appoint examiners;
(d) to confer degrees and to grant
diplomas, certificates and other distinctions and honorary degrees and
to deprive thereof in accordance with the conditions specified by the Regulations.
(2) The Senate may, subject to the
approval of the Vice-Chancellor make a regulations necessary for the exercise
of its functions.
Deposit
of Moneis
23 University monies shall be deposited
in a current or deposit account in such banks in the Sudan as may be approved
by the Council.
Publication
and Audit of Accounts
24 The statement of accounts and the
budget referred to in Section 13, shall be audited annually at the end
of the financial year by the Auditor General or any other auditor appointed
by him and shall be submitted together with the auditor's report by the
Chairman of the Council to the National Council, and shall be published.
Seal of
the University
25 The Vice-Chancellor shall keep
the Seal of the University and the affixing of that seal to any document
shall be made in the presence of an attested by:
(a) The Vice-Chancellor or Secretary
General
(b) The Chairman of the Council or
any other member of the Council authorised by the Council to do so. |
